| Abstract |
The 1945 Constitution of Republic of the Indonesia Constitutes a State fundamental norm (grundnowrm). The peoples Consultative Assembly of the Republic has executed amendment on some of articles of the 1945 Constitution of Republic of the Indonesia in the General Session of the Peoples Consultative Assembly of the Republic of Indonesian from October 14 to 21, 1999, yearly session of the year 2002. In implementing amendment it is needed a profound, accurate and precise discussion. The 1999 ñ 2004 Guidelines of State Policy (Garis-Garis Besar Haluan Negara : GBHN) mentioned that; In Connection with regional autonomy development within the auspices of the Unitary States of the Republic of Indonesia the article 3 chapter 33 of the 1945 Constitution of the Republic of Indonesian should be directed to. The realization of a peaceful, democratic, just competitive, advanced and prosperous Indonesians, within the auspices of the Unitary States of the Republic of Indonesia as supported by the people of Indonesians who are healthy, independent, with faith in and fear towards almighty god, have noble characters, love their homeland, legally and environmentally aware, experts in science and technology, with high working ethos and disciplined, in order to realize the regional autonomy development of natural resources should be directed toward. To manage and maintain supportability so as to benefit the improvement in peoples welfare from generation. To Utilize fully natural resources for peoples welfare by taking into account functional conservation and balance of living environment, sustainable development, economic and local communityís cultural interests, and special arrangement, the implementation of which is regulated by the law. In the frame work of implementing the joint accountability and for the sake of stronger nations unity and integrity, it is needed to improve the peoples active role and the result of the natural resources development should be enjoyed more evenly distribution and fairly by all the Indonesian people for the increasing of physical and spiritual welfare. The paper will deals mostly on the 1945 Constitution, The Decrees of the peoples Consultative Assembly of the Republic of Indonesia related to natural resources, geothermal energy in the frame work of the Indonesian Unitary State. |
